4. Co-Signer Responsibilities

Any individual who co-signs a bail bond (indemnitor) accepts financial responsibility for the full bail amount if the defendant fails to appear in court as required. Co-signers agree to:

  • Notify Tuolumne Bail Bonds immediately if the defendant's location becomes unknown
  • Be liable for all premiums, fees, and costs associated with bond forfeiture or recovery

Indemnification

By entering into a bail bond agreement with Tuolumne Bail Bonds, you agree to indemnify, defend, and hold harmless Tuolumne Bail Bonds and its agents from any and all claims, damages, costs, and expenses, including legal fees, arising from the defendant's failure to comply with any condition of the bail bond.

Defendant Obligations

The defendant and co-signer agree that the defendant will appear at all scheduled court dates, will not leave the state of California without prior written consent from Tuolumne Bail Bonds, will notify Tuolumne Bail Bonds immediately of any change of address, and will comply with all conditions set by the court as part of the bail agreement.

Collateral

In certain circumstances, Tuolumne Bail Bonds may require collateral in addition to the bail bond premium. Collateral is returned after the case concludes and the bail bond is discharged, provided the defendant has met all obligations. The nature and amount of any collateral requirement will be disclosed in writing before the bail bond is executed.

Forfeiture

If the defendant fails to appear at a scheduled court date, the court may order the bail bond forfeited. In the event of forfeiture, the co-signer becomes liable for the full bail amount. Tuolumne Bail Bonds will take all legally available measures to locate the defendant and surrender them to the court to avoid forfeiture or to have the forfeiture set aside.
